Because you’re so important to us, we treat your personal data as if it were our own... carefully and securely. We’re handling it transparently, in-line with our guiding values of Making it Honest and Making it Responsibly.
In a nutshell: We, Heath Ceramics, Ltd. (“Heath,” “we,” or “our”), respect privacy and your rights to control your personal data. After all, we’re human too. The following Privacy Policy, while long and a bit legal sounding, is very important and provides you with explanation about your rights, the personal information we collect from you, as either visitors to our website at www.heathceramics.com (the “Site”), Showrooms, or purchasers of our products, why we collect it, and how we may use it. This Privacy Policy does not apply to your access, use, purchases made, or selling on Pass the Plate (passtheplate.heathceramics.com) (“Pass the Plate”). What’s considered personal information, you ask? Any information that identifies, relates to, describes, is reasonably capable of being associated with or could reasonably be linked, directly or indirectly, with a particular consumer or household. The prime purpose of collecting data is to enhance your shopping experience with us. We do not collect any personal information which does not serve a business purpose. When you purchase any of our products, we retain your name, email address, phone number, and address so that we can process the transaction, create an order, answer queries, and manage returns and refunds. With your consent, we will send you updates about our products and events through our newsletter or emails, from which you may unsubscribe at any time—we won’t be offended.

All activities in which you may engage on the Site, or at one of our retail outlets are voluntary. You are not required to provide any personal information to us unless you choose to access features on the Site which require it or you voluntarily provide us with information at one of our showrooms. You have the right to Access, Correct, and Delete your personal information from our business platforms, services, and devices. You have the right to opt-out from the sale or sharing of personal information at any time across business platforms, services, businesses, and devices. You have the right to limit the use of your sensitive personal information, the unauthorized use of which creates a heightened risk of harm to you as a consumer across our business platforms, services, businesses, and devices. You have the right to request the disclosure about collection, use, disclosure, and sale of personal information; you may request information beyond the 12-month collection period preceding the verifiable consumer request.
If you set up an account or a gift registry at our Site, you can access, review and/or update your profile and settings on the Site, which will allow you to modify or update certain information.
You may delete your account or gift registry by contacting customerservice@heathceramics.com — our team is standing by. You may opt out of receiving future emails or newsletter by Heath, by clicking on the opt-out/unsubscribe link available in our emails and newsletters. To opt out of SMS messages, text STOP to +1 (205) 946-0518. We encourage you to update your personal information promptly when it changes.

We do not discriminate against a consumer because of the exercise by the consumer of any of their privacy rights such as right to access, deletion or opt-out from sale or sharing of your personal information.
We primarily use the information you provide to offer products and services to you, including, but not limited to, the following:
- To send you information or materials via our newsletter, email, or SMS about products, events, and news we think might interest you. Our Site uses certain tags, log files, web beacons, and similar trackers from third parties (collectively, "Cookies"), of which you should be aware. A cookie is a small string of information that websites you visit transfer to your computer for identification purposes. Cookies can be used to follow user activity on the Site and that information helps us to understand user preferences and improve visitors’ Site experience. When three’s company.
We may delegate our authority to collect, access, use, and disseminate your information. For example, our web host stores the information that you provide us, and we may hire outside contractors to perform maintenance or assist us in securing our Site. We may also release certain information to our attorneys, accountants and professional advisors in order to help us comply with applicable laws. It is therefore necessary that you grant the third parties we may use in the course of our business the same rights that you afford us under this Privacy Policy.
For this reason, you hereby agree that for every authorization which you grant to us in this Privacy Policy, you also grant to any third party that we may hire, contract, or otherwise retain the services of for the purpose of operating, maintaining, repairing, or otherwise improving or preserving our Site or its underlying files or systems. You agree not to hold us liable for the actions of any of these third parties, even if we would normally be held vicariously liable for their actions, and that you must take legal action against them directly should they commit any tort or other actionable wrong against you.
We may also share certain information, including your email address and the items you have purchased from us with Treet if you create an account with Treet on Pass the Plate. Treet owns and operates Pass the Plate. Treet uses this information to help you resell Heath products on Pass that Plate that you’ve previously purchased from us. In the preceding 12 months, we have NOT sold any personal information about consumers to third parties.
In the preceding 12 months, we have disclosed the following categories of personal information about consumers to third parties for business purposes:
- Identifiers such as a real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, e-mail address, account name, or other similar identifiers.
- Financial information such as credit or debit card number, or any other financial information not including publicly available information that is lawfully made available to the general public from federal, state, or local government records.
- Commercial information, including records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
- Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding a consumer’s interaction with an internet website application, or advertisement.
- Geolocation data.
Business purposes, as defined by California law, are:
- Performing services on behalf of the business, or service provider, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing advertising or marketing services, providing analytic services, providing storage, or providing similar services on behalf of the business or service provider.
- Helping to ensure security and integrity to the extent the use of the consumer’s personal information is reasonably necessary and proportionate for these purposes.
- Debugging to identify and repair errors that impair existing intended functionality.
- Short-term, transient use, including, but not limited to, non-personalized advertising shown as part of a consumer’s current interaction with the business, provided that the consumer’s personal information is not disclosed to another third party and is not used to build a profile about the consumer or otherwise alter the consumer’s experience outside the current interaction with the business.
- Providing advertising and marketing services, except for cross-context behavioral advertising, to the consumer provided that, for the purpose of advertising and marketing, a service provider or contractor shall not combine the personal information of opted-out consumers that the service provider or contractor receives from, or on behalf of, the business with personal information that the service provider or contractor receives from, or on behalf of, another person or persons or collects from its own interaction with consumers.
- Auditing related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with this specification and other standards.
- Undertaking internal research for technological development and demonstration.
- Undertaking activities to verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by the business, and to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by the business.

For your convenience and to improve the usage of our Site we may insert links to third-party websites on this Site. This Privacy Policy does not apply to such third-party websites. These links take you outside our service and off Heath’s Site and are beyond our control. This Privacy Policy does not apply to Pass the Plate or any similar reseller sites. Those websites have their own separate privacy policies and although we seek to protect the integrity of our Site, Heath is not liable for the content and activities of those third-party websites. Please note that when shopping through our social media channels, such as Instagram or Facebook, or on Pass the Plate, your personal data privacy is covered by the usage agreement between you and that particular third party. Your visits and access to such websites is at your own risk. Those other websites may send their own cookies to users, collect data, or solicit personal information.
Facts are helpful.
We may implement analytics programs such as Google Analytics to track your use of our Site. These analytics programs may collect certain information about you. We will use such information in accordance with this Privacy Policy, but make no representations or warranties as to the use of this information by our analytics service providers. You may opt out of Google Analytics cookies altogether by installing this Google Analytics Opt-Out Add-On.

We use reasonable security controls to protect your data and information from loss, misuse, unauthorized access, disclosure, alteration, and destruction. We are committed to minimizing personal information collection to the information that is necessary for some defined purpose. The personal information you provide us is stored on computer systems located in controlled facilities which have limited access, and only authorized personnel have access to unencrypted user information.
When collecting or transferring sensitive information such as credit card information, we use a variety of additional security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. When we transmit sensitive information over the internet, we protect it through the use of advanced encryption techniques, such as the Secure Socket Layer (SSL) protocol, and have firewalls protecting our critical systems. Additionally, as part of real-time payment processing, we may subscribe to fraud management services. These services provide Heath with an extra level of security to guard against credit card fraud and to protect your financial data.
Despite these precautions, no security safeguards guarantee 100% security all of the time, and no guarantees are made with respect to the same.

We retain your personal information in accordance with our data retention policies and practices. The length of time we keep your information depends upon a number of factors, including the type of information. In general, we retain personal information for as long as we have an ongoing business need to retain it. Following that period, we will delete it.
LEGAL BASIS FOR PROCESSING.
If you are an individual in the European Economic Area (EEA), we collect and process information about you only where we have legal bases for doing so under applicable European Union laws. The legal bases depend on how you use the website or Heath’s products and services:
- We need to collect and use the information for you to use the Site;
- Our collection satisfies a legitimate interest (which is not overridden by your data protection interests), such as for research and development, to market and promote our products and services and to protect our legal rights and interests;
- You give us informed consent to do so for a specific purpose; or
- We need to process your data to comply with a legal obligation.
If you have consented to our use of information about you for a specific purpose, you have the right to change your mind at any time, but this will not affect any processing that has already taken place. Where we are using your information because we or a third party have a legitimate interest to do so, you have the right to object to that use though, in some cases, this may mean no longer using the Site.
The General Data Protection Directive (GDPR) provides individuals in the EEA certain rights with respect to their information. These include the right to request a copy of your information, to object to our use of your information (including for marketing purposes), to request the deletion or restriction of your information, or to request your information in a structured, electronic format. You can exercise these rights by contacting us at the address in the Contact Section below.
The GDPR provides that we may limit or deny your requests in certain cases. For example, if fulfilling your request would reveal information about another person, or if you ask to delete information which we have compelling legitimate interests to keep, including as required by law. You may have the right to complain to a data protection authority in the country where you live, where you work or where you feel your rights were infringed if you have concerns about your rights.
Section 1798.83 of the California Civil Code and the California Consumer Privacy Rights Act requires Heath, and many other businesses, to disclose policies relating to the sharing of certain categories of customers’ personal information with third parties. These businesses are required to accept requests for disclosures of these policies, and the information collected, from customers. We will honor two requests per calendar year. There is a 45 day response window for each inquiry; it may be extended another 45 days if notice is provided within the first 45 days to the customer, along with the reason for the delay. When complying with these requests, Heath will verify the requestor’s identity using a two-step verification process, to ensure personal information does not end up in the wrong hands.
You have the following rights, and upon inquiry we will honor:
-Your right to access: You may request disclosure of the categories and specific pieces of personal information that have been collected about you—the consumer—during the previous 12 months.
-Your right to request deletion: You may request that Heath delete all personal information that has been collected about you. There are some exceptions to what may be deleted, including personal information necessary to complete the request.
-Your right to request disclosure of information collected and/or sold: In addition to your right to access, you may also request disclosure of the categories of sources from which the personal information is collected, the business/commercial purpose for collecting and selling personal information, and categories of third parties with whom we share personal information.
-Your right to opt out of the “sale” of information: Heath does not “sell” your data in the traditional sense. We do, however, use third party platforms to run our Site and business. According to CCPA, any information these third party platforms obtain is considered a “sale” of your information. Heath does not gain financial benefit from this “sale” and you have the right to choose where your information goes, or doesn’t.
-Your right to nondiscrimination: Should you pursue any of the above inquiries, Heath will never discriminate against you, by denying goods or services, charging different prices, varying the quality of our goods, or any other means.
California residents may request such information from us by sending a letter to the address listed below or by emailing customerservice@heathceramics.com. In your inquiry, please provide your name, address, and email address, as well as a request that we provide such information to you, by using the following or similar language, “I request that Heath Ceramics provide its third-party information sharing disclosures.” In limited circumstances, customers' failure to submit requests in the manner specified above will not require a response from us.
